  1. The Central Govt. Service rule/laws applied on each and every central Govt. employees in the same manner but in the case of Raj pal he is getting more benefit then the other lacs of central Govt. employees. How can it possible that one can get the benefit more then the other employees. The judgement of CAT in the case of Rajpal should be applied on the all central Govt. Employees. It is not justice with the other employees that they are getting less benefits then the Raj pal even they are all also central Govt. Employees. Now this is a duties of Hon’ble Courts who have passed orders in other cases to direct the concern ministry to implement the order of Hon’ble Courts and allow the benefits of promotional hierarchy to all other Central Govt. Employees.

MACP which was introduced in 6th CPC to encecourage those deprived of promotion in service is being misinterpreted and hurdles created at every stage discouraging the staff and subjecting them to dissatisfaction. MACP is very simple to implement, it is surprising how how the implementing authorities are obstructing benifit provided to the promotion deprived employees. This stalls the performance of the govt organisations. Intervention of parliament is needed for proper implementation of MACP.

    MACP Sheme is erroneous, self contradictory and disadvantageous for those employees who do not get promotion for 10/20/30 years of service. Financial upgradations under MACP Scheme given under Para 28(iii) (B) , 28(B) only after seven years service and after five years service are contrary to it’s para-1 of Annexure of the MACP Scheme under which financial upgradation is to be granted on completion of 10 years service in the same grade pay.   5. MACP Scheme is erroneous, self contradictory and dis-advantagious. I have some points in this regards which may be useful in supreme court cases. The email address of engineers association is required so that I may send the points through email. kpsingh
