Subject: REVIEW OF PAY FIXATION AS PER ILLUSTRATION 4A of rule 7(i) under CCS(RP) RULES, 2008 AS ON DT. 01-01-2006
As per the recommendation of 6th Pay Commission, Pre-revised pay scale of Assistant Engineer in CPWD has been Upgraded from Rs. 6500-200-10500 to Rs.7450-225-11500 w.e.f. dated 01-01-2006 vide notification of Gazette of India: Extra ordinary Part-II Sec-3(i) and pay of undersigned should be re-fixed as per note 2 A below rule 7 (1) A (ii) of CCS (Revised Pay) Rules, 2008 in the manner indicated in illustration 4 A of Explanatory Memorandum , notified vide GSR no. 622 dated 29-09-2008 circulated vide Deptt. Of Expenditure / MO finance OM F.No. 1/1/2008-IC dated 30-08-2008 (copy enclosed). As In the Upgraded pre-revised pay scale the minimum pay is Rs.7450/- which is computed as per CCS (Revised Pay) Rules, 2008 to Rs.13860/- (Rs.7450/-x1.86= Rs.13857/- i.e. Rs.13860/-), is more than the amount arrived and fixed as per common rule applied to pay of undersigned on 01.01.2006 (i.e. basic pay 7100×1.86=13206/= rounded off to Rs.13210/-) and benefit of bunching of pay was not given. In this regard a representation was also made for correction of same vide my letter dated 24/12/2012(copy enclosed) but no response has been received so far.
In the case of Assistant Engineers of CPWD, due to REVISION OF PAY FIXATION AS PER PARA 7(1)(a) (I) & (II) OF CCS (Revised Pay) Rules 2008 AS ON DATE 01-01-2006 AFTER UP-GRADATION OF POST OF ASSISTANT ENGINEER IN CPWD FROM PRE-REVISED PAY SCALE OF RS. 6500-200-10500 TO RS. 7450-225-11500 , five stages in PRE-REVISED PAY SCALE gets bunched at the same stage so the pay should be fixed after including benefit of bunching in the form of two increments(as tabulated below). The same situation has been re-iterated by Deptt. Of Expenditure/ Ministry of finance vide their OM dated 13-11-2009 (copy enclosed). Grade pay attached to the upgraded scale Rs. 4600/-is to be further added to arrive at the revised basic pay. (Copies enclosed along with enclosures).
It is further mentioned that in case of Assistant Director (OL)( Subordinate cadre of CPWD)which is also upgraded by 6th pay commission ,the benefit of bunching has been allowed by CPWD Directorate vide their OM no. 5/7/2010-EC-IV(SC) dated 06-05-1012(Copy enclosed for your ready reference).
Hence, in view of above facts it is once again requested to kindly review the pay fixation orders of the undersigned and re-fix pay on 01.01.2006 as Rs.14280/-(Rs.13860/-+420/-)+Grade Pay Rs.4600/-as per table below in the upgraded pay scale please.
