    Sir,
    With reference to the above, I submit following few lines for your kind & sympathetic consideration for re fixing of pay as on 01-01-2006;
    As per recommendations of 6th Central Pay Commission the pay scale of Assistant Engineer in Central PWD under Ministry of Urban Development was revised and upgraded from the existing Rs. 6500-200-10500 to Rs. 7450-225-11500 w.e.f.01-01-2006. (Refer Part-C section-II, CCS (RP) Rules 2008 notified vide G.S.R. 622 (E) dated 29/08/2008 by Department of Expenditure; Ministry of Finance.) (Copy of the GSR 622 E is enclosed herewith)
    Further Department of Expenditure (Ministry of Finance) had issued instructions for fixation of pay and payment of arrears vide F. No. 1/1/2008-IC dated 30/08/2008.
    The Sub-Para-ii of Para – 2 of this circular read as under:-
    “Para 2- The sequence of action to be taken on receipt of the option will be as follows:-
    Sub para ii- The table Annex-I will be applicable in cases where normal replacement pay scales have been approved by the Government. In cases of up gradation of posts and merger of pre-revised pay scales, fixation will be done as prescribed in Note 2A and 2B below Rule 7(1) and in the manner indicated in illustration 4A and 4B respectively of the Explanatory Memorandum to the CCS (RP) Rules, 2008.”
    NOTE-2A….. Where a post has been upgraded as a result of the recommendations of the Sixth CPC as indicated in Part B or Part C of the First Schedule to these Rules, the fixation of pay in the applicable pay band will be done in the manner prescribed in accordance with clause(1) (A) (i)& (ii) of Rule 7 by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding the resultant figure to the multiple of ten. The grade pay corresponding to the upgraded scale as indicated in Column 6 of Part B or C will be payable in addition. Refer Illustration 4A in this regard is in the explanatory Memorandum to these Rules.
    NOTE 2B.. In case of merger of pay scales, pay in the revised pay bands will be fixed in the manner prescribed in accordance with Clause(1) (A) (i) and (ii) of Rule 7 by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding the resultant figure to the next multiple of ten. The grade pay corresponding to the upgraded scale as indicated in Column 6 of Part B or C will be payable in addition. Refer Illustration 4B in this regard is in the explanatory Memorandum to these Rules.
    Hence, in case of Assistant Engineers (Civil/Elect) of CPWD under Ministry of Urban Development, where existing pay scale of Rs. 6500-200-10500 has been upgraded to 7450-225-11500 corresponding to the pay in Pay Band PB-2 (9300-34800) with grade pay of Rs 4600/- (para No. 7-4-12 at the 6th CPC Report) the pay fixation has to be done as on 1-1-2006 as per note 2A of clause (1) (A) (i) and (ii) of Rule 7 and in the manner prescribed in illustration 4A annexed to CCS(RP) Rules 2008 with benefits of bunching as admissible.

    Sir, as on 01-01-2006, I was holding the post of Junior Engineer (Elect) but was drawing the pay scale of Assistant Engineer i.e., 6500-200-10500, w.e.f. 09-08-1999 (since I was given with 1st financial up gradation in promotional hierarchy in the pay scale of AE/E on completion of 12 years of regular service in the grade of JE/E and from the date of introduction of ACP Scheme of 09-08-1999).
    Since I was drawing the pay scale of 6500-200-10500 of Assistant Engineer as on 1-1-2006 and this pay scale of Assistant Engineer has been revised and upgraded as per recommendation of 6th CPC as detailed above, Hence the pay fixation in my case, should have been done as on 1-1-2006, in accordance with illustration 4A annexed to CCS(RP) Rules 2008, but this has not been done in my case and the fixation is done wrongly without giving the benefit of increments due to bunching of pay as prescribed in the illustration 4A annexed to CCS(RP) Rules 2008. (Copy of pay fixation is enclosed for your ready reference).
    Your attention is also drawn towards para 4, 5 & 6 of OFFICE MEMORANDUM issued vide F No 1/1/2008-IC dated 13-11-2009 from Department of Expenditure (Implementation Cell) Ministry of Finance, where it is clearly mentioned that in case of up gradation of pay scales w.e.f 01-01-2006, fixation has to be done in accordance with illustration 4A annexed to CCS(RP) rules 2008. (Copy of OM is enclosed for your ready reference).
    It is also brought to your kind notice that in case of Assistant Director (OL) working in CPWD; their existing pay scale of 6500-200-10500 had been revised & upgraded to the pay scale of 8000- 13500 as per recommendations of the 6th CPC. The fixation of pay in this case , as on 01-01-2006, was done in accordance with illustration 4A by giving the benefit of bunching.(refer OM No. 5/7/2010-EC-IV(SC) dated 06-05-2010 issued by the Directorate of CPWD.) (Copy of OM is enclosed for your ready reference).
    You are further requested to refer a judgment pronounced by the CAT Jaipur Bench, Jaipur on 28th Feb 2013 in OA 141/2012,142/2012,143/2012,144/2012,145/2012 &146/2012 in the similar case, where the post & scale is upgraded as per the 6th CPC recommendations, from the existing 6500-10500 to pre revised 7450-11500 corresponding to the revised pay band PB2 of Rs 9300-34800 with grade pay of Rs 4600/-. In this Judgment the respondents are directed to grant benefits of bunching to the applicants as per illustration 4A of Rule 7(i) of CCS(RP) Rules 2008. ( Copy of Judgment is enclosed for your ready reference).
    Accordingly Table-1 is prepared and is also enclosed for your ready reference , showing the details of Pay in the Pay Band of PB-2 ( 9300-34800) after adding the benefit of bunching @ 3% of the Pay, corresponding to the initial pay in the Pre-revised Pay Scale of 7450-11500 (without adding the corresponding Grade Pay of 4600/-) and also in the last column of the table it is shown that the Pay has to be fixed in case of up gradation from the existing pay scale of 6500-10500 to the pre revised pay scale of Rs 7450- 11500 corresponding to the pay in Pay Band PB-2 (9300-34800) with grade pay of Rs 4600/- as on 01-01-2006.
    Hence, In my case ( RAMESH RAI JE/E , now AE/E,) where the basic pay as on 01-01-2006 , in the existing pay scale of 6500-10500 was Rs 8100/- and the pay scale has been revised & up graded to the pre revised pay scale of Rs.7450-11500 as per recommendations of 6th CPC; the pay in this case should be fixed as per note 2A of clause (A) (i) and (ii) of Rule 7 and in accordance to illustration 4A annexed to CCS(RP) Rules 2008 after allowing the benefit of increments due to bunching of pay. Therefore the Pay in this case as on 01-01-2006 has to be fixed at 15620+4600=Rs.20220/- instead of Rs.19670/-(15070+4600).

    Considering the above facts , It is requested to review, correct & re fix the pay as on 1-1-2006 as per illustration 4A annexed to CCS(RP) Rules 2008 by granting/allowing the benefit of increments due to bunching of pay as admissible. I further request to pay me the arrears (if any) arising out of the revision of pay w.e.f. 1-1-2006.
    An early action in the matter shall be highly appreciated.

    Since I was drawing the pay scale of 6500-200-10500 of Assistant Engineer as on 1-1-2006 and this pay scale of Assistant Engineer has been revised and upgraded as per recommendation of 6th CPC as detailed above, Hence the pay fixation in my case, should have been done as on 1-1-2006, in accordance with illustration 4A annexed to CCS(RP) Rules 2008, but this has not been done in my case and the fixation is done wrongly without giving the benefit of bunching as prescribed in the illustration 4A annexed to CCS(RP) Rules 2008.     Hence, In my case ( SHISHPAL SINGH JE/C , now AE/C,) where the basic pay as on 01-01-2006 , in the existing pay scale of 6500-10500 was Rs 7700/- and the pay scale has been up graded to the pre revised pay scale of Rs.7450-11500 as per recommendations of 6th CPC; the pay in this case should be fixed as per note 2A of clause (A) (i) and (ii) of Rule 7 and in accordance to illustration 4A annexed to CCS(RP) Rules 2008 AFTER ALLOWING THE BENEFIT OF BUNCHING. Therefore the Pay in this case as on 01-01-2006 has to be fixed at 15160+4600=Rs. 19760/- instead of Rs.18930/-(14330+4600).

    Considering the above facts , It is requested to review, correct & re fix the pay as on 1-1-2006 as per illustration 4A annexed to CCS(RP) Rules 2008 by granting the benefits of additional increments due to bunching of Pay as admissible.
    I further request to pay me the arrears (if any) arising out of the revision of pay w.e.f. 1-1-2006.
    An early action in the matter shall be highly appreciated.

  2. This is in connection of up gradation of pay scale from 6500-10500 to 7450-11500 as per 6th. CPC for AEs in CPWD. Can anybody tell in detail about the bunching of scale of pay? Here in the illustration 4A at page-63 of the gazette notification of 6th. CPC, Rs.5820/- became Rs.6060/- after bunching in old scale, obviously multiplied by 1.86. But Rs.3200 X 1.86=Rs.5952, say 5960/-(which is not equal to Rs.6060/-). So please clarify for Rs.6060/-. Praveenji/Shispalji should clarify the same as they have raised this great issue for the benefit of poor AEs. Thanks.
