Restoration of ACPS-Humble Request to All Members.
Of late many comments showing frustration of our members who are not able to get 6600/-GP with severe criticism of our Assn especially myself personally is being shown on our website and through SMSs to me. Some even blame that I have not made whole hearted efforts to restore the benefits of ACPS to all junior members in 4600/-GP. The frustration can be understood but the criticism has no justification.
First and foremost is whatever our Assn has tried to do to solve this tricky issue is through various deliberations in Apex committee meetings from time to time and other meetings over the years since 2008. The Central Office only followed the directives of Apex. There is nothing personal to it. The moment the Govt. asked us to give option we have submitted our preference for restoration of ACPS even by asking them to amend the Para 13 of the OM/guidelines to choose the ACPS. This is as per the Apex decision and promises made in various meetings. If CPWD/MOUD sends the proposal on some lines and the same is not accepted by the DoPT, why Assn is being blamed? For following the Apex decisions? The DoPT accepts everytime that injustice is caused to our cadre in the MACPS but is not ready to solve the problem it created. They have still not yet amended the Para 13 as decided in the National Anomaly meetings. Their adamant stand that both schemes can not run concurrently is not at all justified which has been categorically observed by the Punjab&Haryana High Court in CWP No. 19387 of 2011 decided on 19/10/2011 wherein the order wasThat apart the contention raised by the learned counsel for the petitioners to the effect that the earlier scheme of ACP stood superseded by MACP Scheme is being noticed only to be rejected. The entire objective of introduction of the ACP/MACP Scheme is to alleviate stagnation as regards an employee who has number of regular years of service on the same post without any avenue of promotion. It is under such circumstances that a financial incentive is sought to be granted to an employee upon completion of a certain number of years of service on the same post. Under the ACP Scheme of 1999, the financial upgradations were to be granted upon completion of 12 years and 24 years of regular service whereas under the MACP Scheme such financial upgradations are envisaged upon completion of 10/20 or 30 years of service. The contention raised on behalf of the petitioners if accepted would defeat the very objective for which such schemes have been introduced.That being so, the stand of DoPT stands exposed. Every time they accept that injustice is done but their adamancy in saying that the schemes can not run concurrently or individuals can not be given option is totally illogical.
After the latest proposal from our Dept/Ministry is turned down yet again by DoPT, we met the Joint Secretary of our Ministry yesterday and requested him to resubmit the proposal for Restoration of ACPS with whatever terms and conditions and modalities decided by DoPT i/c cut-off date. In the meanwhile we are exploring feasibility and desirability of going to Court of Law demanding the individual member’s accrued benefits from ACPS can be restored. Some members in the Eastern Region have also prepared the grounds and the draft case which may kindly be shared with us. But whatever avenues to get the restoration done will be tried whole heartedly and there is no doubt in our minds that we will get the benefits of ACPS back.
MY ONLY HUMBLE REQUEST TO OUR LEARNED MEMBERS IS TO STRENGTHEN OUR HANDS WITH YOUR SUPPORT AND FAITH AS REPEATED CRITICISM WILL ONLY BRING DOWN THE MORALE OF LEADERSHIP WHICH WILL NOT HELP US IN ANY WAY. KINDLY NOTE THAT 4 OUT OF 6 ELECTED OFFICE BEARERS HAVE NOT GET 6600/- GP TILL DATE AND NATURALLY THIS IS THE ONLY ASSN WHICH IS MAKING EFFORTS RIGHT FROM THE YEAR 2008 TO GET BACK THE ACPS BENEFITS.
Surprisingly, the leadership of the cadre which should have fought tooth and nail to get the ACPS restored is not questioned but our Assn which is trying to protect the granted benefits to all junior and senior members by striking a balance of their aspirations is being targeted repeatedly even by those cadre leaders. We are trying our best and will do our best in forcing the dept to accept our genuine demand sooner than later. At this juncture what is needed is your faith and moral support coupled with constructive suggestion than talk of 3rd Assn. Our cadre’s bargaining power is already effected due multiplicity of Assns. and any talk of further split is recipe for disaster.
