IMPORTANT CAT JUDGEMENT REGARDING -MACP

     A copy of letter dated 14.08.2013 of Ministerial Staff Association, Survey Of India, Dehradun addressed to the ,Secretary to The Government Of India,Department of Science and Technology, on the above cited subject is attached herewith . The case of MACP to be given on the bases of hierarchy of post has been explained in detail in the said letter based on the Judgement of the CAT,Principal Bench, New Delhi which has been upheld by the hon’ble high court as well as the hon’ble Supreme Court of India.

It is very much clear from the para 8 (as reproduced below)of the orders dated 26-11-2012 issued by the Hon’ble CAT,Principal Bench, New Delhi in OA No.904/2012 in case of Sanjay Kumar, UDC and 18 Others ( copy attached), that the pay scale/grade pay is to be given as per the hierarchy of the promotional posts and not in the bases of hierarchy of the pay scales.

“In fact , the respondents have wrongly interpreted the terms and conditions mentioned in the MACP Scheme,issued by the Deptt. Of Personnel & Training,in case of the applicants. By the said Scheme, the eligible government servants are to be placed in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay and not merely in the next higher scale of pay as per the recommendations of the 6th Pay Commission.In the Hierarchy after the scale of UDC the next scale is that of Assistant.Therefore,the respondents should have given the next higher grade pay and pay band attached to the next promotional post in the hierarchy ,namely,the Assistants carrying the pay scale of Rs. 9300-34800 and the grade of Rs.4200/”.

Hence it is evident from the said judgment that the MACP scheme has been wrongly implemented in the case of JE/AEs of CPWD. AEs on completion of 20 years of service are required to be given the next higher grade pay and pay band attached to the next promotional post in the hierarchy, namely, the Executive Engineer carrying the pay scale of RS. 15600-39100 and the grade pay of Rs. 6600/-.

  1. It is not understood that why the Association should concentrate only for the 2nd ACP . Why not for the MACP on hierarchy of next higher post. Those who are in the Grade pay of Rs. 7600/= should submit representations to the DG(w) for the Basic Pay of rs.37400 with Grade Pay of Rs. 8700/= as there is no Cadre of CPWD IS EXISTING as per Manual Vol. I and no basic pay of Rs. 12000 for any of the cadre of CPWD. the NEXT PAY OF THE PRE REVISED PAY SCALE OF 10000 TO 15300 IS 14300 to ………… i.e. the SEs pay scale and the Basic pay in the revised pay scale is 37400 with the grade pay of Rs. 8700/-

    It is an EXCELLENT judgement for engineering cadre and it is the time for united fight to get our MACP to the rank of the Superintending Engineer instead of Rs. 7600. In this juncture the central leaders must have trip to all Inida level for mobilization and by fighting we can obtain the MACPssociations includind ALL ENGINEERING DEPARTMENTS OF STATES AND DELHI SUCH AS DDA, MCD, DUSIB should come out immediately to get the MACP on hirarcy,,, IF THIS IS NOT IMPLEMENTED THAN A BIG GAP IN PAY SCALES ON NEXT PAY COMMISSION SHALL BE DEVELOPED, for example… Rs. 425… revised to Rs 1400/- then to 5000/- than– 9300+4200= 13500 means almost 3 times ,,now if for IInd term MACP it will be 9300+4800… but it should be 15600+6600,,, imagine in next PAY COMMISSION same may upgraded to…. 9300+4800=14100 x3= 42300 and 15600+6600=22200×3=66600,,, see 42300 and… 66600… so let us fight and GOT IT<<<<<<<<<<<,

  5. It is a very good judgement in the needy hours of our base cadre and it is the time for united fight to get our MACP to the rank of the Superintending Engineer instead of Rs. 7600. In this juncture the central leaders must have trip to all Inida level for mobilization and by fighting we can obtain the macp grade pay of Rs. 8700 based on this judgement. T. Manoharan.
    The graduate and diploma should be forgotten. When the retired Diploma AE CPWD is treated at par with the Graduate Engineer when he employed by a contractor, why he should not be treated at par with the graduates while he is in service ? The central leaders should come out immediately to get the MACP on hirarcy. T. MANOHARAN.
